The AICA President has referred your question and point of clarification regarding the procedures for the election and appointment of the Inaugural President-Elect of the Australasian College for Infection Prevention and Control (ACIPC) to the NCSC. We are pleased to provide the following advice on behalf of the NCSC:
1.The authority, provisions, and guidelines for the appointment of the Inaugural President-Elect are set out in multiple documents, namely the 2011 Constitution of the Australasian College for Infection Prevention and Control and the 2011 Foundational Operational Guidelines for the Australasian College for Infection Prevention and Control.
2.The 2011 Foundational Operational Guidelines for the Australasian College for Infection Prevention and Control establishes that where there is discrepancy between the description outlined in this document and the Australasian College for Infection Prevention and Control Constitution, the Constitution prevails as the authoritative instrument.
3.Section 15 of the 2011 Constitution of the Australasian College for Infection Prevention and Control provides for the appointment of the Inaugural President-Elect.
4.The 2011 Foundational Operational Guidelines for the Australasian College for Infection Prevention and Control (p. 4) establishes that The members will elect the President-Elect from nominated members at the November 2011 AICA AGM. AICA will be responsible for the election and the National Consultative Steering Committee will undertake the vetting process to ensure all meet the selection criteria prior to presentation election at the AICA AGM.
5.I refer to your interpretation of the nominated members [group], pursuant to page 4 the 2011 Foundational Operational Guidelines for the Australasian College for Infection Prevention and Control. The nominated members are not the ACIPC Executive Council. Rather, they are any and all individuals who are nominated and are vetted and approved by the NCSC to stand for election as President-Elect.
6.The Call for Nominations and election of the President-Elect from nominated members (that is, individual members who are nominated and are vetted and approved by the NCSC to stand for election as President-Elect) at the November 2011, as mooted in the 2011 Foundational Operational Guidelines for the Australasian College for Infection Prevention and Control, did not proceed due to an unavoidable delay in finalising one aspect of the Transition arrangements.
7.Section 15.9 of 2011 Constitution of the Australasian College for Infection Prevention and Control establishes that Prior to 1st July 2013 at a designated time general elections will be held for executive council member positions and a PresidentElect.
8.Pursuant to Section 15.9 of the 2011 Constitution of the Australasian College for Infection Prevention and Control, AICA and the NCSC have determined that processes for the election of President-Elect will now proceed. Accordingly, the Call for Nominations for President-Elect has been promulgated and the election will now proceed.
