Yes Michael I thought I has indicated that i.e. if more onerous follow that
and Vic EPA is more onerous atm. However for some states and territories the
new standards are more onerous so now that AS has been released that takes

My meagre legal knowledge tells me that is a state has an Environmental
Protection Act or equivalent with a definition of clinical waste, this will
take precedence over an Australian Standard, until the Act is repealed or
altered. Best advice would be to check with your state statutory authority.Cheers

CW Standard AS 3816:2018 is voluntary, i.e. not legally binding unless it
has been incorporated into a states legislation.The AS website at

public to comply with standards. However, State and Commonwealth
governments often refer to Australian Standards (AS) or joint

take precedence over an Australian Standard, until the Act is repealed or

fax. 03 9439 2436Hi Michael, you are correct, the recently updated and published Australian CW Standard AS 3816:2018 is voluntary, i.e. not legally binding unless it has been incorporated into a states legislation.
The AS website at https://www.standards.org.au/standards-development/what-is-standard states:
On their own, standards are voluntary. There is no requirement for the public to comply with standards. However, State and Commonwealth governments often refer to Australian Standards (AS) or joint Australian/New Zealand Standards (AS/NZS) in their legislation.

My meagre legal knowledge tells me that is a state has an Environmental Protection Act or equivalent with a definition of clinical waste, this will take precedence over an Australian Standard, until the Act is repealed or altered. Best advice would be to check with your state statutory authority.
